FCA delivery is one of the trade terms of the Incoterms 2010 guide, which means the release of the seller from the obligation to pay for the delivery of goods to the recipient.

Seller Responsibilities:

1. Provision of goods in conformity with the contract

Depending on the agreed place of transfer of the goods, the seller undertakes to provide the carrier or the person authorized by the buyer access to the goods on his territory, deliver the goods to the place of loading indicated in the commercial contract. The seller must provide the goods according to the contract together with an invoice, electronic message or other documents evidencing the transfer of goods.

2. Customs clearance of the export of goods

The seller undertakes to completely and at his own expense carry out the export clearance of the goods or other official authorization and comply with all customs formalities necessary for the export of goods.

3. Contract of carriage and insurance

I) Contract of carriage

At the request of the buyer, the seller can conclude a contract for transportation

4. Delivery

The seller undertakes to deliver the goods to the carrier or other person (for example, the forwarder) indicated by the buyer at the named place or point (for example, a transport terminal or other pick-up point) on the date or during the period agreed upon in the contract.

I) In the case of rail transportation, when the goods are delivered to the wagon or container cargo, the seller must load the wagon or container accordingly. Delivery is completed when the wagon is loaded or the container is transferred by rail or to another person acting on behalf of the buyer.

If the goods do not constitute a wagon or container loading, the delivery is completed when the seller sends the goods to the railway collection point or loads it into the vehicle provided by the railway.

II) In the case of road transport, when loading takes place at the seller’s premises, delivery is completed when the goods are loaded into the vehicle provided by the buyer.

Delivery is completed when the goods have been transferred to the carrier or to another person acting on behalf of the buyer.

III) In the case of sea transportation, when loading takes place in the port, delivery is completed when the goods are loaded onto the transported vessel provided by the buyer and transferred to the carrier or another person acting on behalf of the buyer.

When the container is delivered to the operator of the transport terminal, acting on behalf of the carrier, it is considered that the goods were accepted.

5. Risks

The seller bears all risks of loss or damage to the goods until it is transferred to the buyer or to another person acting on behalf of the buyer in accordance with paragraph 4.

6. Costs

I) The seller undertakes to pay all costs associated with the goods until it is delivered to the person acting on behalf of the buyer in accordance with paragraph 4.

II) The seller undertakes to pay customs costs, as well as all duties, taxes and other official fees paid when exporting the goods.

7. Notice to the Buyer

The seller undertakes to notify the buyer that the goods have been transferred to the carrier or to another person acting on behalf of the buyer.

8. Delivery confirmation, transport document

The seller undertakes to provide the buyer with a document (bill of lading) confirming the transfer of goods.

9. Checking-packaging-marking

I) The seller undertakes to pay the costs of those verification operations (such as quality control, measurement, weighing, counting), which are necessary for the delivery of goods to the carrier.

II) The seller undertakes to provide at his own expense the packaging that is necessary for the transport of goods. Packaging should be labeled accordingly.

 

Buyer Responsibilities:

1. Payment

The buyer agrees to pay the cost indicated in the contract at the specified time.

2. Customs clearance of import of goods

The buyer undertakes to completely and at his own expense carry out import clearance of the goods or other official authorization and fulfill all customs formalities necessary for the import of goods and, if necessary, for transit through another country.

3. Contract of carriage

The buyer undertakes at his own expense to conclude a contract for the transport of goods from the place specified in the contract.

4. Risks

The buyer bears all risks of loss or damage to the goods after the goods have been transferred to the carrier or to another person acting on behalf of the buyer.

5. Notice to the Seller

The buyer agrees to provide the seller with information about the carrier and, if necessary, indicate the type of transport, as well as the date or time of delivery of the goods and, depending on the circumstances, the point where the goods should be delivered to the carrier or to another person acting on behalf of the buyer.

6. Delivery confirmation

The buyer agrees to notify the seller of the acceptance of the goods.
